831192406 &#8211; 3 Route de Rauzan &#8211; 33460 &#8211; Margaux-Cantenac &#8211; in the person of its legal representative duly authorized to conclude the present contract (hereinafter the &#8220;Seller&#8221;), publishes and operates the website accessible at the URL shop.chateau-marquis-de-terme.com <\/p><p>The Site is an online sales site on which a winegrower\/chateau (the &#8220;Seller&#8221;) markets its products. The Seller is a wine professional wishing to have a solution enabling him to offer his wines (the &#8220;Products&#8221;) to private buyers via the Internet (the &#8220;Customers&#8221;). Internet users browsing the Site, Customers and the Seller are hereinafter referred to as &#8220;Users&#8221;.   <\/p><p>These General Terms and Conditions of Sale (the &#8220;GTCS&#8221;) govern the relationship between the Vendor and any individual of legal age in his or her country of residence placing an order on the Site (the &#8220;Customer&#8221;). They apply to sales of Products concluded between the Vendor and the Customer on the Site. In accordance with the provisions of article L.3342-1 of the French Public Health Code, the Vendor reserves the right to ask the Customer to provide proof of identity and age.   <\/p><p> <\/p><p><strong>Article 2 &#8211; ACCEPTANCE OF GENERAL TERMS AND CONDITIONS OF SALE <\/strong><\/p><p>2.1 &#8211; By placing an order, the Customer acknowledges that he\/she has read the present GTC and agrees to be bound by them. <\/p><p>2.2 &#8211; The General Terms and Conditions are subject to change at any time. The customer is bound by each modification and should therefore regularly visit this page to check the current version of the general terms and conditions.  <\/p><p>2.3 &#8211; The Customer may print out these General Terms and Conditions or save them on his\/her computer in PDF format. <\/p><p>IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS, DO NOT PLACE ORDERS ON THIS SITE.  <\/p><p> <\/p><p><strong>Article 3 &#8211; RESPONSIBLE ALCOHOL CONSUMPTION  <\/strong><\/p><p>The Customer acknowledges that the consumption of alcohol must be moderate and responsible. The Seller undertakes to promote the moderate use of its products. Irresponsible alcohol consumption can cause serious damage to health and society. For further information: http:\/\/www.responsibledrinking.org\/     <\/p><p> <\/p><p><strong>Article 4 &#8211; PRODUCTS  <\/strong><\/p><p>4.1 &#8211; Description of Products  <\/p><p>Each Product offered on the Site is described in terms of its essential characteristics. The photographs or graphic representations used to illustrate the Products, whether standard or customized, are not contractually binding.   <\/p><p>The Seller must comply with French standards applicable to the products sold. The Vendor may be required to modify its Products and packaging in order to comply with these standards, in particular by integrating logos and\/or mandatory information. <\/p><p>4.2 &#8211; Product availability  <\/p><p>Product offers are subject to availability. In the event of unavailability, the Product may no longer be ordered on the Site.   <\/p><p>In the event that the product is no longer available in the quantity ordered, the Vendor will inform the Customer so that he may decide whether or not to accept the reduction of his order. If the Customer does not agree to this reduction, the order will be automatically cancelled and reimbursed as soon as possible.   <\/p><p> <\/p><p><strong>Article 5 &#8211; ORDERING  <\/strong><\/p><p>5.1 Creating a customer account  <\/p><p>5.1.1 &#8211; The Customer will be able to create an account on the Site at the time of his\/her first order and, to this end, will have to fill in the form provided. This form includes &#8220;mandatory&#8221; information required to identify the Customer (title, surname, first name, date of birth, e-mail address and password). The Vendor may, if necessary, ask the Customer to confirm (by any means) the information provided and his\/her identity.   <\/p><p>The creation of an account is limited to one per person (same first name\/last name and same household\/postal address). Any attempt at fraud (use of a false or misleading <\/p><p>identity,  <\/p><p>spelling of the name or surname truncated\/modified&#8230;etc) may result in the deletion of the account.  <\/p><p>5.1.2 &#8211; The Customer may also order without creating an account, by ordering as a guest. To do this, they need only provide the information required to process their order.   <\/p><p>5.2 &#8211; Ordering steps  <\/p><p>To order a product on the Site, the Customer must follow the steps below:  <\/p><p>The Customer selects the Products he wishes to order and adds them to the basket by clicking on &#8220;Add to basket&#8221;.  <\/p><p>They can access their basket by clicking on &#8220;Basket&#8221;.  <\/p><p>On the &#8220;Shopping Cart&#8221; page, the Customer can :  <\/p><p>&#8211; Add\/remove items from your shopping cart,  <\/p><p>&#8211; Enter their PROMO CODE (promotional code) if they have one, &#8211; View the summary of their basket, including any promotions applied. To proceed to the next step, the Customer must (i) accept the present General Terms and Conditions of Sale made available to him via a hypertext link by clicking on the checkbox provided for this purpose, and (ii) click on &#8220;Validate my Cart&#8221;.     <\/p><p>Customers are then asked to identify themselves, unless they are already logged in; if they already have a customer account, they enter their email address (login) and password. If they do not have a customer account, they create a customer account where they order as a guest.   <\/p><p>When ordering for the first time, the Customer is redirected to the &#8220;Delivery Address&#8221; page in order to enter his\/her delivery and\/or billing address. They then click on &#8220;Save address&#8221;.   <\/p><p>The Customer is automatically redirected to the &#8220;Delivery&#8221; page in order to define their delivery details. Customers can modify their delivery or billing address by clicking on &#8220;Modify&#8221; or &#8220;Add a new address&#8221;. It is also at this stage that the Customer must provide any administrative documents required for the order to be processed correctly, in particular to clear customs in the destination country in full compliance.    <\/p><p>To proceed to the next stage, the Customer must click on &#8220;Confirm delivery&#8221;, which will take them to a summary of the information they have provided. At this stage, the Customer is informed that any error in the information provided may result in the cancellation of the order. Once the order has been validated, the Customer is taken to the &#8220;Payment&#8221; page.  <\/p><p>Customer selects payment method.  <\/p><p>To definitively confirm and pay for the order, the customer clicks on &#8220;Confirm my order and pay&#8221;. The customer is then redirected to the payment service provider&#8217;s transaction platform, where he\/she enters his\/her bank details and confirms payment.   <\/p><p>Once the Customer has validated and paid for his\/her order, (i) he\/she is automatically redirected to a page on the Site on which the Vendor confirms his\/her order, (ii) at the same time, the Customer receives an e-mail from the Vendor acknowledging receipt of his\/her order and providing him\/her with an order number and a summary of his\/her order.    <\/p><p> <\/p><p><strong>Article 6 &#8211; PRICE AND PAYMENT TERMS  <\/strong><\/p><p>6.1 &#8211; Prices  <\/p><p>The prices of the Products are those indicated on the Site at the date of the order. They are indicated in the currency chosen by the customer from among 21 currencies.   <\/p><p>By displaying the basket details, the customer has access to the price including taxes, duties and customs clearance as well as delivery.  <\/p><p>6.2 &#8211; Billing  <\/p><p>A detailed invoice will be issued for each order and sent to the Customer by e-mail at the same time as confirmation of dispatch of the order (or at the time of payment).  <\/p><p>6.3 &#8211; Terms of payment  <\/p><p>All credit card payments are made via the secure online payment system.  <\/p><p>The Customer is the holder of the card used. The Customer is then automatically redirected to the transaction platform of the bank providing the payment. Banking information is entered via a secure server, guaranteeing the security and confidentiality of the information provided by the Customer during the banking transaction.    <\/p><p>An order confirmation is sent by e-mail to the Customer. The order placed is firm and definitive. Placing an order implies full acceptance of the terms and conditions.    <\/p><p>of these GTC. The SIte&#8217;s automatic recording systems are considered to be <\/p><p>by the parties as proof of the nature, content and date of the order.  <\/p><p>Regardless of the method of payment chosen, the Vendor reserves the right to refuse any order or delivery in the event of (i) refusal to authorize payment by the banking institution or (ii) total or partial non-payment of a previous order by the Customer.    <\/p><p> <\/p><p><strong>Article 7 &#8211; SHIPPING  <\/strong><\/p><p>The Products are delivered through the services of PELICAN AIR SERVICES, a simplified joint stock company with a capital of 5,000 euros, registered with the RCS of Bergerac B 882 558 315, whose registered office is located at Local m\u00e9t\u00e9o, a\u00e9roport de, 24100 Bergerac (hereinafter the &#8220;Service Provider&#8221;).  <\/p><p>Shipments are made mainly* by DDP (delivery duty paid), guaranteeing that the customer has no formalities to complete and no additional costs to pay on delivery.  <\/p><p>The Service Provider issues the waybill, and handles administrative and customs formalities, with follow-up until delivery.  <\/p><p>The customer receives a global price for delivery to his home address, and the Service Provider pays customs duties on the customer&#8217;s behalf. The Customer is informed by email or sms of the time of delivery.   <\/p><p>*Exceptions :  <\/p><p>Shipments to the 4 provinces of Canada are DAP (delivery at place), as regulations in this country require the customer to pay duties directly to the government departments of each province. Information is provided on the customs clearance process. Delivery is made by the Service Provider and its partners to the address indicated.    <\/p><p> <\/p><p><strong>Article 8 &#8211; DELIVERY  <\/strong><\/p><p>8.1 &#8211; Delivery methods, rates and delivery times  <\/p><p>Payment of the order triggers the collection of the goods from the producer&#8217;s property by the Service Provider.  <\/p><p>The Service Provider monitors the merchandise throughout its entire life cycle and manages for the<\/p><p>on behalf of the Vendor and the Customer, all situations (absence, relay point information, customs blockage, etc.) with the utmost care in order to offer delivery in the best possible conditions.  <\/p><p>In the case of a shipment, the customer may be contacted by e-mail by the country&#8217;s customs department or other authorities. Under no circumstances should the customer reply to this e-mail. The customer has a contact email address for all questions and information relating to his goods: customers@pelicanairservices.com    <\/p><p>All shipments are delivered to the address indicated on the identification form. It is the customer&#8217;s responsibility to check the delivery address on the order confirmation. It is important that the contact details provided are valid and that the contact is available.    <\/p><p>The Service Provider cannot be held responsible for any input errors made when identifying the addressee, making delivery impossible (address errors, etc.). In the event that the Service Provider cannot intervene to modify the input error resulting in the return of the goods to the logistics base, the cost of reshipment and the cost of return shall be borne by the Customer. In the event of refusal by the Customer, the goods are retained by the Service Provider.    <\/p><p>If the Customer is absent at the time of delivery, the parcel is left at the nearest collection point to the delivery address. The customer is informed by email, or any other means, of the address of the collection point where the parcel has been dropped off. The customer has 15 days to collect the parcel, failing which it will be returned.    <\/p><p>The Service Provider cannot be held responsible for the return of an unclaimed parcel. The customer is responsible for the return shipping costs. In the event of refusal, the goods will be retained by the Provider.    <\/p><p>Delivery costs vary according to the number of bottles, the size of the bottles, the unit price of the bottles, the type of bottle packaging (carton, wooden crate, etc.) and the country\/state of destination selected by the Customer.  <\/p><p>8.1.1 &#8211; The Products offered for sale on the Site are manufactured and marketed in accordance with current French standards.  <\/p><p>8.1.2 &#8211; The delivery times displayed by the Service Provider when the order is validated are an estimate only and are not binding on the Service Provider. Estimated delivery times are calculated in working days (Monday to Saturday, excluding public holidays).   <\/p><p>8.1.3 &#8211; Each order is delivered to a single address. If the Customer requests delivery to more than one address, separate orders must be placed.   <\/p><p>8.1.4 &#8211; The Service Provider&#8217;s 6-bottle, 12-bottle and magnum packaging is reinforced and suitable for international transport.<\/p><p>Wooden cases for magnums, 6 and 12 bottles are protected by recycled polyethylene foam and over-packed in Pelican Air Services packaging. Bottles, double magnums, jeroboams and other non-standard volumes are secured in Pelican Air Services packaging.   <\/p><p>The Service Provider takes great care with packaging to minimize the risk of damage.  <\/p><p>8.2 &#8211; Transfer of risk and ownership  <\/p><p>During transport, the risks of destruction, loss or damage to the Product(s) are borne by the Seller (without prejudice to any recourse the latter may have against the Service Provider responsible for delivery).  <\/p><p>The transfer of risk and ownership of the Products takes place on the date of delivery of the Products to the delivery address indicated by the Customer. Delivery is defined as the handing over of the order to the Customer or his representative at the address indicated on the order form.   <\/p><p>8.3 &#8211; Checking the order on receipt  <\/p><p>Upon delivery, the Customer must check the condition and conformity of the Products delivered and, if necessary, enter any reservations on the delivery note.  <\/p><p>8.4 &#8211; Declaration of damage  <\/p><p>Upon receipt of goods which have been damaged, the customer must meet the following conditions in order to benefit from the guarantee, failing which he will be excluded:  <\/p><p>&#8211; Make a reservation on the delivery note &#8220;reserve, damaged package&#8221; and take a photo.  <\/p><p>&#8211; Take photos of the closed package, of the package when opened, and of any damaged goods  <\/p><p>And send all information to litiges@pelicanairservices.com  <\/p><p>The declaration is processed as quickly as possible, and only the damaged goods are replaced. Bottles with stained labels are not eligible for replacement insurance.  <\/p><p>8.5 &#8211; Objection to acceptance  <\/p><p>The Customer can access the proof of delivery by contacting the Service Provider, using the tracking number of his parcel. In the event that the Service Provider indicates that the order has been delivered and the Customer has not received it, the Customer may contact the Service Provider by email at litiges@pelicanairservices.com in order to open a dispute file. In order to contest  <\/p><p>On delivery, the Customer must provide a signed declaration and a copy of his or her identity document (passport or ID card, both sides). On receipt of these documents, the Service Provider will begin a search. The time taken for the Provider to locate the parcel is 3 (three) weeks.    <\/p><p>The Service Provider is entitled to request a complaint to be lodged in the event of any dispute concerning receipt or signature.  <\/p><p> <\/p><p><strong>Article 9 &#8211; REPLACEMENT INSURANCE  <\/strong><\/p><p>Standard replacement insurance applies to all national, EU and non-EU shipments, and to all types of packaging: 6 bottles, 12 bottles, magnums, wooden crates, etc&#8230; It applies in the event of damage or loss of packaging.  <\/p><p>The standard insurance limit varies according to the type of package:  <\/p><p>&#8211; Packs of 6 bottles or 3 magnums: \u20ac200  <\/p><p>&#8211; Packs of 12 bottles or 6 magnums: 350\u20ac.  <\/p><p>Use cases :  <\/p><p>&#8211; A package of 12 bottles worth \u20ac300 is covered by replacement insurance in the event of partial or total damage.  <\/p><p>&#8211; A package of 12 bottles valued at \u20ac600 is covered by replacement insurance for \u20ac350, whether for damage to one bottle valued at \u20ac350 or to several bottles whose total value does not exceed \u20ac350.  <\/p><p>The Service Provider replaces the spoiled bottle and reships it at its own expense. If the bottle is no longer available, a refund will be offered at market value.   <\/p><p>Additional insurance representing 1.35% of the value of the goods is offered for purchases exceeding the ceiling, guaranteeing full replacement in the event of damage or loss of the package. Visits that start late will be shortened to finish on time. <\/p><p><strong> <\/strong><\/p><p><strong>ARTICLE 7 &#8211; LIABILITY<\/strong><\/p><p>The visit to Ch\u00e2teau Marquis de Terme is carried out under the sole responsibility of the Customer.<br>The Customer will be held responsible for any damage, direct or indirect, that he or she may cause, or that may be caused by persons or things in his or her custody, during their presence on the estate, whether to the staff and\/or customers present, or to any equipment made available to the Customer by Ch\u00e2teau Marquis de Terme.<\/p><p>The Vendor may not be held liable if the non-performance or improper performance of its obligations under the GCS is attributable either to the Customer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.<\/p><p><strong> <\/strong><\/p><p><strong>ARTICLE 8 &#8211; PAYMENT SECURITY<\/strong><\/p><p>The Site is protected by a security system.<\/p><p>The Vendor guarantees that the encryption means and services used to secure transactions have been authorized or declared in accordance with current legislation.<\/p><p><strong> <\/strong><\/p><p><strong>ARTICLE 9 &#8211; PERSONAL DATA<\/strong><\/p><p>The Vendor undertakes to respect the confidentiality of personal data communicated by the Customer and to process them in accordance with the French Data Protection Act no. 78-17 of January 6, 1978.<br>Information and personal data transmitted to the Vendor by the Customer are subject to computer processing and may be used by the Vendor, its internal departments, its subcontractors, its partners or its assignees, depending on the authorizations given by the Customer, in order to:<\/p><p>Processing, execution and management of purchases;<\/p><p>Handling requests for information and\/or complaints;<\/p><p>Inform customers of upcoming events;<\/p><p>This information and data is also stored for security purposes, in order to comply with the Seller&#8217;s legal and regulatory obligations.<\/p><p>The Seller undertakes not to communicate information relating to the Customer to third parties other than its partners and subcontractors responsible for the management, execution, processing, payment and\/or follow-up of Ticket purchases. The Vendor may, however, be required to communicate such data in response to an injunction from the legal authorities. <\/p><p>In accordance with Article 34 of the French Data Protection Act updated by European Regulation No. 2016\/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data any Customer, providing proof of identity, may exercise his or her right to access, rectify and\/or delete information concerning him or her contained in the Seller&#8217;s databases.<br>Customers also have the right to limit the processing of their personal data, to have their data deleted, to have their personal data ported, to withdraw their consent, and to lodge a complaint with the Commission Nationale de l&#8217;Informatique et des Libert\u00e9s (CNIL).
